General Terms and Conditions

1. Applicability
For the business relations between the customer and the Ultracyclingshop exclusively these General Terms and Conditions apply in the version valid at the time of conclusion of the contract. The contracts are concluded exclusively as distance contracts through online purchase of the customer in the online shop. Thus, the contract and any communication in question takes place online. The contract conditions of the company apply, deviating conditions of the customer can not be recognized.
The current version of the General Terms and Conditions is available on the company's website (www.ultracyclingshop.com). The respective version is valid on the day of the order.

2. Contract conclusion
The offer is made by submitting the fully completed order form provided on the website. The confirmation of the order is made by e-mail to the customer, which includes the products as well as the price, delivery and payment conditions. This automatically sent order confirmation does not constitute a valid purchase contract, but merely informs about the receipt of the order.
The acceptance of the offer takes place only by the dispatch of the ordered products and services to the customer. The shipment of goods is confirmed by an e-mail to the customer, which also contains a tracking number of the package, by means of which the customer can see the shipping status of his package.

3. Refusal / non-fulfillment of orders placed
The Ultracyclingshop can reject orders placed. If an online order is not executed, the orderer will be informed immediately and the invoice amount will be refunded. All customer notifications regarding open orders are made via email.

4. Revocation / right of withdrawal
The customer can withdraw from his purchase within 14 days without giving reasons. This period begins on the day on which the customer, or a third party appointed by the latter, who is not the carrier, has taken possession of the goods. In order to exercise your right of withdrawal, you must inform us by means of a clear statement of your decision to withdraw from this contract.

The customer bears only the direct costs of returning the goods. In order to maintain the 14-day withdrawal period, it is sufficient if the declaration of withdrawal and the return of goods takes place within this period.
The right of withdrawal does not apply to the following contracts:
Goods that are delivered sealed and are not suitable for return for reasons of public health or hygiene, provided that their seal has been removed after delivery
Services provided in connection with leisure activities, provided that the contractor has contracted for a specific time or period.
When claiming the right of withdrawal, the Ultracyclingshop shall repay the payments made by the customer, including delivery costs (excluding return shipping costs), no later than fourteen days from the date on which the notice of cancellation of this contract is received.
Consequences of the cancellation
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery charges, no later than fourteen days from the date on which we received notice of your cancellation of this contract. For this repayment, we will use the same form of payment that you used in the original transaction and you will not be charged for this repayment. We have the right to refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods. The customer only has to pay for a possible loss of value of the goods, if this loss of value is due to damage of the customer.

We are ready to participate in an out-of-court conciliation procedure before a consumer arbitration board.

5. Delivery / shipping costs
Unless a separate Lieferfirst is specified on the product page, processing and shipping - if not acc. Item 3 of the rejection of the order is made use of - within 10 days (excluding the post office) after receipt and acceptance of the order.
The shipping costs within Austria are 2.90 euros, within Germany 4.90 euros. Goods can only be shipped by standard shipping. A pickup of the ordered items is not possible.

By confirming your order, you agree that our shipping partner DPD may inform you by email about your consignment. When shipping your ordered items, you will receive an email from DPD with a tracking link. With this you can always see the delivery status of your shipment.

6. Prices and payment options
All prices quoted by the Ultracyclingshop are, unless otherwise stated, gross prices including VAT.
The customer can pay for orders in Austria and abroad by credit card (Visa, Mastercard) as well as via PayPal or Sofortüberweisung upon conclusion of the contract.

7. Warranty and liability
Ultracyclingshop is responsible for defects that exist in the delivery of the goods, within the framework of statutory provisions. The warranty period is 2 years beginning with the acceptance of the goods by the customer. During the legal warranty period, the customer first has the right to free repair or replacement of the goods. If a defect can not be remedied, the customer is entitled to conversion (cancellation of the purchase) or reduction (reduction of the purchase price). The warranty for customers who are entrepreneurs within the meaning of the KSchG is limited to 6 months.
Ultracyclingshop accepts no liability for damages incurred during use, without any defects before use. Also excluded from a warranty are wear and tear that may occur during use (especially in clothing).

8. Retention of title and set-off
The delivered goods remain the property of the Ultracyclingshop until full payment of the purchase price and shipping costs.
The offsetting of counterclaims of the customer against claims of the Ultracyclingshop is excluded.

9. Privacy Policy
The Customer agrees to the storage and processing of the Customer's information contained in the Agreement for bookkeeping and customer evidence purposes. The data will be used for the fulfillment of legal regulations, for the handling of payment transactions and for communication regarding orders and their dispatch from us. The data will be treated in accordance with the currently valid data protection law (Neue Datenschutzgrundverordnung Mai 2018) and a disclosure to third parties is excluded. You agree that your personally identifiable information may be used by Ultracyclingshop to contact you by email, telephone or SMS for the purpose of sending information about your order.

10. Applicable law
All contracts between the Ultracyclingshop and a customer are based exclusively on Austrian law.
Jurisdiction for disputes arising from contracts with customers is Graz (ZRS Graz), unless compelling legal regulations provide for a different place of jurisdiction.

12. Severability clause
Should individual provisions of these General Terms and Conditions be or become wholly or partially invalid or unenforceable, this shall not affect the validity and validity of the remaining conditions.
